Child Custody
In Pakistan, child custody laws are governed by the Guardians and Wards Act of 1890 and the Muslim Family Laws Ordinance of 1961. Under these laws, the father is considered the natural guardian of a child and is typically granted custody in the event of a divorce/khula. However, the court may award custody to the mother or another guardian if it is deemed to be in the best interests of the child. The court also has the power to award joint custody to both parents.
